SugarSight Terms and Conditions for Educator
This document outlines the Terms and Conditions of the agreement between you (the “Educator”) and SugarSight from Vishvasys Technologies Pvt. Ltd. (“SugarSight” or “VTPL”) for the use of the SugarSight mobile application and its associated services.
By accessing, registering for, and using the SugarSight platform as an Educator, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
1. Services Provided by SugarSight
SugarSight provides a platform that facilitates the following services for you to engage with patients and users:
- Patient Education: Conduct educational sessions related to diabetes management, healthy lifestyle practices, glucose monitoring, medication adherence, and self-care.
- Tele-Education Sessions: A secure, end-to-end encrypted video conferencing service to conduct one-on-one or group educational sessions with users.
- Patient Engagement: Access to patient information relevant to education and counseling, subject to patient consent.
- Educational Content Sharing: Tools to share educational materials, awareness content, lifestyle recommendations, and self-management resources.
- Scheduling: An appointment booking system that enables patients to schedule educational sessions based on your availability.
2. Educator’s Responsibilities
As an Educator on the SugarSight platform, you agree to:
- Provide VTPL with valid educational qualifications, certifications, experience details, and other relevant professional credentials.
- Provide accurate and up-to-date information regarding your qualifications, expertise, and professional background.
- Conduct educational sessions in a professional, ethical, and respectful manner.
- Ensure that all information provided to patients is evidence-based, accurate, and aligned with accepted diabetes care and health education practices.
- Maintain strict patient confidentiality and protect sensitive personal data in accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act) and SugarSight’s Privacy Policy.
- Refrain from diagnosing medical conditions, prescribing medications, altering prescribed treatments, or providing medical advice that falls under the scope of a licensed medical practitioner.
- Refer patients to qualified healthcare professionals whenever medical evaluation, diagnosis, or treatment is required.
- Comply with all applicable laws, regulations, and professional standards governing health education services in India.
3. Financial Terms and Payment Agreement
This section details the financial arrangements and payment structure for services rendered through the SugarSight platform.
- Session Fee: The fee for each educational session is determined by you and displayed to the patient on the app. The range of the fee can be ₹100–₹1,000 per session.
- Revenue Share: SugarSight will collect the full session fee from the patient on your behalf. As consideration for providing the platform, technology, and patient base, SugarSight will retain a portion of this fee.
- Payment to Educator: You shall receive 80% (eighty percent) of the gross session fee. The remaining 20% (twenty percent) shall be retained by SugarSight as a service fee.
- Deductions: The following statutory deductions will be made before payment is disbursed:
- Goods and Services Tax (GST): SugarSight is responsible for remitting GST to the government. We will deduct 18% GST on our 20% service fee.
- Tax Deducted at Source (TDS): TDS shall be deducted as per applicable Indian Income Tax laws. A TDS certificate will be issued as required by law.
- Payment Schedule: Payouts will be processed monthly for all completed educational sessions during the preceding month. Payments will be credited to the bank account provided in your profile.
4. Cancellation Policy
The Educator may choose to cancel a pre-booked appointment through the app. However:
- Repeated cancellations may impact platform ratings and visibility.
- SugarSight reserves the right to review cancellation patterns and take appropriate action where necessary.
- Patients shall be notified of any cancellations through the platform.
- Refunds and rescheduling shall be governed by SugarSight’s applicable policies.
5. Patient Data and Privacy
You acknowledge that patient data is confidential and sensitive.
- You shall access patient information only for the purpose of providing educational services.
- You shall not disclose, share, copy, or misuse patient information in any manner.
- SugarSight will provide access to patient data only with the patient’s explicit consent.
- Any breach of confidentiality may result in immediate suspension or termination from the platform and may attract legal consequences under applicable laws.
6. Disclaimer of Liability
SugarSight acts solely as a technology platform connecting Educators with patients and users.
- SugarSight does not provide healthcare, medical, diagnostic, or treatment services.
- Educators are solely responsible for the educational guidance, awareness sessions, and recommendations they provide.
- Educators shall not represent themselves as medical practitioners unless appropriately licensed and registered.
- SugarSight shall not be liable for any claims, disputes, losses, or damages arising from the Educator’s services, conduct, statements, or recommendations.
7. Termination
This agreement may be terminated by either party with one week’s written notice.
SugarSight reserves the right to suspend or terminate your access immediately, without prior notice, in the event of:
- Violation of these Terms and Conditions.
- Breach of patient confidentiality.
- Submission of false qualifications or credentials.
- Misconduct, unethical behavior, or activities that may harm patients or the reputation of SugarSight.
8. Governing Law and Dispute Resolution
This agreement shall be governed by the laws of India.
Any disputes arising from or relating to this agreement shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka.
