“SugarSight app and website” is a diabetes management service provided by Vishvasys Technologies Private Limited, a company incorporated under the provisions of the Companies Act, 2013  and having its registered address at Flat No 307, 2nd Floor, LVS Lavender Apartment, Horamavu, Bengaluru North – 560 043, Karnataka, India  (hereinafter referred as “VTPL”/ “Vishvasys”/ “We” / “Our”) that contains health and health-related information about an individual or multiple-related-individuals that is/are submitted and/or entered by healthcare providers, healthcare organizations, and/or the individual and/or his or her assignee(s) and that is accessible to such individual in a secure and controlled environment.  

These terms and conditions read with the Privacy Policy, Shipping, Delivery, Cancellation and Return of third-party products, Payment, Cancellation and Refund policies available on the App/website constitutes a legally binding agreement between you and VTPL and shall apply to and govern your visit to and use of the App/website and any of its products or Services including all information, data or Services provided to you through the App/website. 

1. ACCEPTANCE OF TERMS 

By downloading, registering for, or using this diabetes management app named SugarSight (“SugarSight” or “App”) , you agree to abide by these Terms and Conditions ,Privacy Policy, Shipment, Delivery, Cancellation and Return of third-party products and Cancellation and Refund policies (“Terms”).Please ensure that you read and understand all these Terms before you use the App/website. If you do not agree, then kindly refrain from using the App/website or avail any of the Services/products being provided herein. 

Your acceptance of the Terms shall be deemed to include your acceptance of the Terms and Conditions, Privacy Policy, Shipment, Delivery, Cancellation and Return of third-party products and Cancellation and Refund policies available at the App/website. If you do not agree with the terms contained in this agreement, you are not permitted to use the App/website. We may revise these terms of use at any time by amending this page and the terms hereof. The revised terms of use shall be updated on The App/website and you are expected to check this App/website from time to time and take notice of any change that we make as they are binding on you. 

VTPL shall not be liable for any consequences arising from your unauthorized use. 

2. DEFINITIONS 

1. “Account” shall mean the account created by you for availing the Services provided by VTPL. 

2. “Applicable law” shall mean and include applicable statutes, enactments, ordinances, rules, bye-laws, regulations, notifications, circulars, guidelines, directions, policies and orders of any governmental authorities, tribunals or courts situated in India. 

3. “Application” shall mean VTPL’s mobile application and/or website operated by VTPL or any other software that enables the use of the App/website and as updated by VTPL from time to time. 

4. “Customer/you/user/your” shall mean and include i) any person/individual availing the Services on his/her consent through the App/website including his/her representative who has been given access by the account creator or a user of the App/website who has an account  on the App/website ii)medical practitioner or health care provider including caregivers, nutritionists and dieticians wishing to be listed on the App/website for receiving and analyzing your data iii) any other visitor of the App/website. 

5. “Registration Data” shall mean and include present, true and accurate name, phone number, email id and such other information that may be required by VTPL from you from time to time for registration on the App/website. 

6. “Third-Party Products” shall mean any good or service developed and provided by an independent company, rather than the one you are directly engaging with, and is offered to customers through that intermediary company.  

7. “Services” shall mean the various categories of services including the following, made available through the App/website. 

• Real-time glucose monitoring and error correction 

• Secure cloud-based data storage and sharing 

• Telehealth functionalities (video consultations, diet plans) 

• Integration with external health platforms (Google Fit, Apple Health) 

• Logging of key diabetes-related activities (meals, exercise, insulin) 

• Data visualization and reporting 

• Patient engagement and educational tools 

• Ordering prescription medication through trusted partners 

• Ordering lab tests at home through trusted partners.  

8. “Force majeure” shall mean any and all events arising due to any cause beyond the reasonable control of VTPL. 

3. DESCRIPTION OF SERVICE 

This App provides features for people with diabetes to: 

• Collect, monitor, and share continuous glucose monitor (CGM) data. 

• Record, upload, and share prescriptions, lab reports, and additional health information through a secure, cloud-based platform. 

• AI-powered food logging with voice input to estimate calories and carbohydrate content. 

• Automated alert systems for hypoglycemia and hyperglycemia events, based on glucose thresholds. 

• Integration with third-party platforms: Google Fit and Apple Health, enabling synchronization and analysis of exercise, activity, nutrition, and other health metrics. 

• Health summaries: Automated overviews, visual dashboards, and health trend reports for patients, caregivers, and healthcare professionals. 

• In App Orders: Users can order Third-Party Products and order medication through partner services such as Tata 1MG.  

• Medicine Orders and Lab Report Bookings: Users can order medicine from third party medicine marketplace through our application. They can also order diagnostic tests from nearby diagnostic centers/labs. 

4. REGISTRATION AND MANNER OF USAGE OF ACCOUNT 

You shall ensure that the Registration Data provided by you is accurate, complete, valid, current and is updated from time to time. VTPL shall not bear any responsibility or liability for false, incomplete, outdated or incorrect Registration Data provide by you. 

You are solely responsible for maintaining the confidentiality of your Registration Data and will be solely liable for all activities and transactions that occur through your account whether initiated by you or any third party.  

A single user may register and log in under multiple roles (e.g., as both a patient and a caregiver), if their circumstances require it. However, multiple accounts for the same role under the same individual is not permitted. Your account cannot be transferred, assigned, to any third party. 

VTPL shall not be liable or responsible for any loss that you may incur as a result of someone else using your password or account either with or without your knowledge. 

VTPL reserves the right to suspend your account with immediate effect and for a period determined by VTP if VTPL has a reason to believe that the Registration Data or any other data provided by you is incorrect or false or the security of your account has been compromised in any or for any other reason that we deem it fit. 

Users will have the option to permanently close or delete any of their role-based accounts from within the app. This action is irreversible and will remove all associated data for that specific role. 

5. CONFIDENTIALITY 

VTPL does not wish to receive any confidential information or proprietary information of yours on its App/website except for the Registration Data and any other data including health data submitted by you during the use of the Services offered through the App/website “Required Information”. 

You acknowledge that any other information other than Required Information that you submit will not be considered confidential or proprietary and VTPL shall not be held liable for any such information. 

6. MEDICAL DISCLAIMER 

• This App is NOT a substitute for diagnosis, treatment, or advice from a licensed healthcare professional. 

• Calorie and carbohydrate estimations, health summaries, and CGM alert systems provide informational support only. Actual values may vary with individual conditions, food preparation, device accuracy, and data completeness. 

• Always consult with your healthcare provider before acting on information from the App, modifying medications, or making dietary changes. 

• Do not ignore professional advice or delay seeking it because of the App. 

7. USER ACCOUNT AND DATA SECURITY 

• You are solely responsible for account security and keeping your login credentials confidential. 

• Immediately notify support of unauthorized access or suspected security breaches. 

• Industry-standard encryptions and security measures are used, but absolute data security is not guaranteed. Transmission of data is at your own risk. 

8. DATA USAGE, SHARING & THIRD-PARTY INTEGRATIONS 

• The App collects, stores, and processes health data you provide or authorize, including CGM data, voice input, prescription information, labs, activity metrics, and data synchronized from platforms like Google Fit and Apple Health. 

• Data may be shared in real time with caregivers and healthcare professionals, as initiated by you, or by your explicit settings. 

• Voice data for AI food recognition is used only for nutritional estimation and system improvement (unless you provide further consent). 

• Data from third-party platforms is imported, displayed, and optionally summarized for your use. You control which data types are shared and may revoke access at any time. 

• Data is never sold to third parties. Data is shared externally only as required by law, or by your direction, or to facilitate clinical care as permitted under your privacy settings. 

• Data will be stored on cloud servers within the jurisdiction of India. 

• By using these integration and summary features, you acknowledge the importance of reviewing health summaries with medical professionals and understand that all shared data is governed by your explicit permissions and the App’s Privacy Policy. 

9. USER RESPONSIBILITIES 

• Submit accurate, complete, and updated information (voice descriptions, manual entries, etc.). 

• Carefully review all AI-generated results and medical alerts for accuracy and consult professionals as needed. 

• Maintain your devices, app settings, and operating systems for optimal and secure functioning. Grant required data permissions for full-service functionality. 

• React appropriately to hypoglycemia/hyperglycemia alerts and keep thresholds synchronized with your medical advice. 

10. AI & SYSTEM LIMITATIONS 

• AI-powered features (like calorie/food estimation) depend on user input clarity and included food databases. They may not recognize regional or branded foods. Estimates may be inaccurate due to ambiguous voice descriptions, missing data, or atypical items. 

• Alert system notifications depend on the proper function of your CGM device, App connectivity, and device notification settings. Technical issues or user misconfiguration may cause missed or delayed alerts. 

• Third-party integrations (Google Fit/Apple Health) rely on those platforms’ stability and data accuracy. Gaps or errors from those services are not the App’s responsibility. 

• System performance may be affected by device incompatibility or incomplete data permissions. 

11. LIMITATION OF LIABILITY 

• The App, its developers, and affiliates are NOT liable for any direct or indirect damages, injuries, diagnosis delays, medical outcomes, or losses from the use, misuse, or inability to use the App or any information provided—including but not limited to missed alerts, AI inaccuracies, third-party service failures, technical issues, or data breaches. 

• App summaries, estimates, and recommendations do not constitute medical advice and should not form the sole basis for health decisions. 

• In any case, the entire liability of VTPL shall be limited to the amount paid by you to subscribe to the Services provided on the App/website. 

12. WARRANTY 

Subject to your compliance with instructions provided by the third party for the use of the Third-Party Products, VTPL warrants the product against defects in material and workmanship under ordinary consumer use and agrees to replace the product if a complaint is raised within 3 days from the delivery of the product to you. This limited warranty applies only to hardware components of the product that are not subject to accident, misuse, neglect, fire or other external causes, alterations, repair or commercial use. You are obligated to comply with the terms and conditions that VTPL provides to activate and validate your warranty. In the event of any further complaints, you may write to the third party providing the product.  

Returns and refunds are not applicable to third party devices unless the sensor is faulty as provided above.

For Third-Party Products listed in our App/website please refer to the warranty information on the manufacturer’s official website. 

Any warranty claims for Third-Party Products or for the replacement as specified in the replacement policy shall be between the third party and you. 

VTPL under no circumstance be liable or responsible for such warranties and shall not be obligated to resolve any disputes between you and such third party. 

Please check the invoice and the product manual received at the time of delivery of the Third-Party Product for the details of any specific warranty. 

The aforesaid terms shall be read in conjunction with the terms of use and other policies published by VTPL on our App/website. 

13. CANCELATION/REFUND 

You may cancel the subscription at any time before the next billing cycle. The cancellation button available on the app can be used to cancel the subscription. If the user faces any trouble while cancelling the subscription, they may contact our customer support  sugarsight@vtpl.tech  Kindly note we cannot offer any refund for cancelation of the subscription already availed. 

14. PAYMEMT OPTIONS 

The subscription service will be paid through the google play store or the apple app store. In order to book appointments, we currently offer secured  payment options through our partner Razorpay and may introduce other intermediary third party for payment at a later date. 

You may pay online using available option such as debit cards, credit cards, UPI, internet banking and other payment methods as provide by VTPL. 

VTPL may charge payment gateway fees which will be clearly specified in the payment summary before you complete the transaction.   

15. INTELLECTUAL PROPERTY RIGHTS 

Except as otherwise indicated, all intellectual property rights in the App/website and any content therein reside with VTPL and are protected by law for the time being in force and may not be used by you except in connection with usage of the App/website in accordance with these Terms. 

16. PRIVACY POLICY 

Your privacy policy governs the collection, use, dissemination, and retention of your data. By accepting these Terms, you also accept the App’s Privacy Policy. 

17. SHIPPING AND DELIVERY POLICY 

If you order Third-Party Products through our App, the shipping and delivery times are as per the Shipping, Delivery, Cancellation and Return of Third-Party Products Policy. Please note that, VTPL is not responsible for delivery of medications ordered through third party platforms that are integrated into our App.  

18. MODIFICATIONS TO TERMS 

We reserve the right to change, modify, or discontinue the App or these Terms at any time. Material changes will be posted in the App and take effect upon posting. Continued use after changes constitutes acceptance. 

19. TERM AND TERMINATION 

We may restrict, suspend, or terminate your access for violation of these Terms or at our discretion. Any remaining data is governed by the Privacy Policy, and you may request deletion subject to legal requirements. VTPL shall have the right to immediately terminate the Services and use of the App/website in case of noncompliance with any of the above Terms/requirements.

In case you are unable to access your account please contact us at the above email and may send a written request to blocking your account. VTPL shall not be responsible or liable for any unauthorized transactions made through your account prior to expiry of ____ days after you have made a request for blocking your account. 

By registering and using SugarSight App, you confirm that you have read, understood, and consent to these Terms and Conditions. 

By accepting these Terms, you hereby grant a non-exclusive, worldwide, perpetual, sub- licensable, irrevocable, royalty free right of your Required Information in any media. 

You hereby agree and permit VTPL to share any of your Required information to third parties to facilitate the Services including any value-added services offered by such third parties. 

You hereby expressly consent to receive communication from VTPL and third parties services or the value-added service to you on your registered online number and/or on your email id. 

You agree that you will not hold VTPL responsible for any such communications received from third parties and such communication will not be treated as violation of your registration on the do not call/disturb.  

21. LICENSE  

Subject to your compliance with these Terms, VTPL grants you a limited, non-exclusive, non-sub-licensable, non-transferable, revocable license to download and install a copy of the Application on an electronic device that you own or control and to run such copy of the Application solely for your own personal use and to use the website. 

22. INDEMNIFICATION 

You agree to defend, indemnify and hold harmless VTPL, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the Service and App/website; (ii) your violation of any term of this Agreement; (iii) your violation of any third party right, including without limitation, any copyright, property, or privacy right; or (iv) any claim that your user content caused damage to a third party. This defense and indemnification obligation will survive this Agreement and your use of the Service and App/website. 

23. 3RD PARTY SITES 

This App/website may be linked to the App/website of third parties, affiliates and business partners. VTPL is not directly or indirectly implying any approval, endorsement or affiliation with any of these linked websites unless specifically stated. VTPL is not responsible for any offerings of any businesses or the content of the third-party websites. VTPL shall not be responsible or liable for the actions/products/Services and contents of any third parties. You acknowledge that VTPL has no control over the content, accuracy or quality of such websites or made available through our App/website. If you are dissatisfied with our App you are requested to immediately discontinue using the App/website and it shall be your sole remedy. 

24. DISCLAIMER 

You expressly acknowledge and agree that you are installing and using the App at your own risk. The App/website and all data and contents provided through the App is provided “as is”, “with all faults” and without warranty, terms or conditions of any kind. VTPL and each of its licensees, affiliates and authorized representatives (the “parties” or “party’) expressly and specifically disclaim all warranties, terms or conditions, whether express or implied, including, but not limited to, any implied warranties of merchantability, satisfactory quality, non-infringement and fitness for a general or particular purpose with respect to the app and content or those arising from course of dealing or usage of trade. VTPL cannot and does not warrant that the App/website will operate without interruptions, that it will be free from viruses and errors, or that the App will not interfere with the functioning of other software or programs installed on your cellular mobile device and will meet your requirements. No oral, written or electronic information or advice given by any party shall create any warranty, term or condition with respect to the App or otherwise. 

The App may be subject to breaches of security and VTPL shall not be held responsible for any resulting damage to any user’s device from any such breach including but not limited to any virus, bugs, tampering, unauthorized intervention, omission, deletion, defect etc 

VTPL provides no assurance that any specific errors or discrepancies will be corrected. 

VTPL is not liable for any network faults or downtime in network services. You agree and acknowledge that relay of text messages is network dependent and VTPL is not responsible for any messages failing to reach their intended recipients. 

The App uses the read only memory (rom) of your cellular mobile phone to function efficiently and effectively. You agree and acknowledge that the App might automatically hibernate or go into standby mode if the rom on your cellular mobile phone is insufficient to run the Apps and functions. VTPL is not responsible for the App hibernating and you agree that you are solely responsible to keep your cellular mobile phone optimized. 

It is possible that the App may get locked or stop working if the data on your cellular mobile phone causes your phone to crash or requires the operating software to be reinstalled. VTPL is not liable or responsible to you in any manner whatsoever for such an occurrence. 

If you have any medical history that may put you at risk or you have not been physically active, you are required to seek approval from a qualified healthcare professional prior to using the Service particularly if you are diagnosed with high BP, heart diseases, dizziness or loss of consciousness, obesity, diabetes, high cholesterol, bone or joint problems , arthritis etc. 

The content of the App/website including without limitation, audios, videos, photographs, illustrations, graphics., and other visuals is for information purposes only and does not constitute/ subsite professional medical advice, diagnosis, treatment, or recommendation of any kind. You should always seek the advice of your qualified heartcare professionals with any queries or concerns that you may have regarding your individual needs and any medical conditions. 

You hereby agree that you will always seek professional medical advice and under any circumstances not delay in seeking such advice in reliance or any content or report provided on the App/website. Reliance on such content is solely at your own risk. 

25. SEVERABILITY 

If any provision herein in part or as a whole, is held to be unenforceable, invalid or illegal by any governmental entity or qualified as such, pursuant to any regulation or law currently in force, the policy or the remainder of the partially offended provision shall not be affected or impaired thereby. 

26. FORCE MAJEURE 

VTPL shall not be responsible for any failure to perform any obligations under this Terms if the performance is delayed, interrupted or prevented by Force Majeure event. In such cases VTPL’s obligations under the Terms shall be suspended as long as the Force Majeure continues. 

27. MISCELLANEOUS 

VTPL reserves the right to withdraw or amend the Service or any feature withing the Services that we provide on our App/Website by notifying the same on our App/Website from time to time without prior notice to you. 

VTPL will not be liable for any reason if for any reason if our App/website or the Services or any features withing the Services are unavailable at any time or for any period. 

From time to time, we may restrict access to some features or parts of the App/website to users who are registered with us. 

This policy constitutes the entire agreement between VTPL and you regarding the terms and conditions of the App/website. 

28. GOVERNING LAW 

These Terms shall be construed, interpreted and governed by the laws of India and shall be subject to the jurisdiction of the Courts in Bengaluru.
